Sosyal devlet ilkesinin gereği olarak Anayasanın 61. maddesi özel olarak korunması gereken kişilere ayrılmıştır. Türkiye’nin özel şartlarından kaynaklanan sebeplerle harp ve vazife şehitlerinin, dul ve yetimleriyle, malul ve gazilerin sosyal hakları konusu yine bu kapsam içinde özenle belirtilmiş ve düzenlenmiştir. Bu çalışmanın amacı, Anayasa ve çeşitli yasalarla sosyal hakları güvence altına alınan harp ve vazife şehitlerinin, dul ve yetimleriyle, malul ve gazileri çeşitli anlaşmalar, yasalar ve uygulanan politikalarla ilgili durumu ve yaşadıkları sorunları çeşitli yönleriyle değerlendirmektir.

In respect to social state principle, the 61’ st article of the Constitution is allocated for disadvantaged people. Because of special situations of Turkey, social rights of the casualties, the orphans and the widows, the handicapped and the veterans were determined and organized in this article. The main aim of this study is to evaluate the laws, policies and problems of the casualties, the orphans and the widows, the handicapped and the veterans who were preserved by the Constitution and some laws.
